We have seen many times with our clients a lot of confusion about what the word inability means. Which is understandable as it means different things in different contexts. It is a level of cognitive impairment, often dementia in our older clients, which has legal significance. There are things we can’t do if we’re incapacitated and there are things our families can’t do until we’re incapacitated, and that’s just the beginning of the confusion.
For most older people, once the cognitive impairment begins, it does not go away and usually gets worse. It is so important to understand the details or the dos and don’ts of the inability to make sure you do your planning before it’s too late.
