If the government is not able to determine the methodology for how to calculate these social benefits in particular, especially when it comes to the Guaranteed Minimum Income, where neither the government nor the Ministry of Welfare was clear about what it is for, so it is up to parliament. The guarantee of fundamental rights cannot be left to such a voluntary, political market, it is not acceptable in a state governed by the rule of law, ”the Government’s inaction in the field of benefits commented Tguard.
Jansons explained that in its judgment, the ST has given a task to the parliament and the government, namely – the political talks between the government and the Union of Local Governments of Latvia (LPS) ended with some figure snatched into the air, which is not based on economic calculations and social reality. The ST judgment specifically states that the legislator must determine any social benefit at the level of the law, with a specific purpose and determining the methodology.
Recall that GMI is benefit for ensuring the guaranteed minimum income level for a family (person) who has been recognized as destitute in accordance with the procedures specified in regulatory enactments and whose average income for the last three months is less than 128.06 EUR per month (Cabinet Regulation No. 913).
